Eminent Domain and Condemnation

Eminent Domain is the right of a government entity or public utility, to seize private property for a public purpose so long as the property owner is justly compensated.

An owner of property that has been condemned, or is under threat of condemnation, has the right to contest the government’s valuation of the property.  A property owner also has other enforceable rights under State and Federal Law including the right to contest the property acquisition. However, some or all of these rights may be waived without taking timely and appropriate legal action.
